Appeals court sides with employee in workers’ compensation case
In 2011, truck driver Steve Dunteman was performing his job duties when he got a blister on his foot. He lanced the blister, but later his wound got infected and he lost his toe, in large part because of his diabetes.
The Illinois Workers’ Compensation Commission ruled that Dunteman should not receive workers’ compensation benefits because his diabetes and lack of infection prevention contributed to the infection more than the workplace injury did. However, an appeals court for the state recently reversed the ruling. University of Illinois professor of law Michael LeRoy said causation is one of the most important aspects considered in workers’ compensation cases.
