Judge Barberis’ decision on workers’ compensation overturned
Illinois appellate judges from each district ruled that Madison County Circuit Judge John Barberis’ decision on claimant Diane Patterson’s injury be overturned because the court has no jurisdiction on the case. Initially, the court ruled Patterson’s injury was not the result of a work-related accident in the Collinsville Rehabilitation and Healthcare Center.
Justice Thomas Hoffman (First District) delivered the Rule 23 decision on Tuesday, September 27, writing that while the parties did not make an issue of the Madison County Circuit Court’s jurisdiction on appeal, “this court has an obligation to examine the jurisdictional issue sua sponte.” After a hearing on the case, an arbitrator discovered that Patterson was not able to provide evidence that her injury resulted from a work-related accident. She then sought review of the decision by the Illinois Workers’ Compensation Commission, which reversed the arbitrator’s ruling on July 7, 2015. Collinsville Rehabilitation then sought a judicial review on the case in the Madison County Circuit Court, with Barberis overturning the decision of the Illinois Workers’ Compensation Commission on Nov. 18, 2015.
